On October 9, 2015, Governor Brown signed Senate Bill 655 which is an add-on to Sections 17920 and 17920.3 of the Health and Safety Code. This bill adds new conditions to the definition of substandard housing. Mold is now part of enforceable substandard conditions in California housing.
The bill specifies that visible mold growth (as determined by a health officer or a code enforcement officer) is a type of inadequate sanitation and therefore a substandard condition.
The exception is for minor mold conditions found on surfaces that can accumulate moisture as part of their properly functioning and intended uses, such as mold in showers.
